User Agreement

Your use of the website & app – www.thesafetyfirst.co.in (hereinafter referred to as “the website & app”) and services available on a website & app is governed by the following terms and conditions. This User Agreement for the website & app shall come into effect on September 1, 2022.

Amendment to user(s) agreement

Job safety first may change, modify, amend, or update this agreement from time to time without any prior notification to user(s), and the amended and restated terms and conditions of use shall be effective immediately on posting. You are advised to regularly check for any amendments or updates to the terms and conditions contained in this User Agreement. If you do not adhere to the changes, you must stop using continued. Your continued use of the service will signify your acceptance of the changed terms.

User(s) eligibility

User(s) means any individual or business entity/organization that legally operates in India or in other countries, uses and has the right to use the services provided by Job Safety First. Our services are available only to those individuals or companies who can form legally binding contracts under the applicable law i.e. Indian Contract Act, 1872. As a minor, if you wish to purchase an item on the Website & app such purchase may be made by your legal guardian or parents who have registered as users of the Website & app.

Job safety first advises its users that while accessing the website & app, they must follow/abide by the related laws. Job safety first is not responsible for the possible consequences caused by your behavior during using the website & app & app. Job safety first may, in its sole discretion, reserve the right to terminate your membership and refuse to provide you with access to the Website & app & App at any time.

We record buying and browsing activities of our users including but not limited to YOUR contact details and profiles and use the same to provide value-added services to our users. If you are registering as a business entity, you represent that you are duly authorized by the business entity to accept this User Agreement and you have the authority to bind that business entity to this User Agreement. Please note our website & app is also not a risks proof website & app.

    To become a Registered User(s) there is a proper procedure which is for the convenience of user(s) so that they can easily log in and l User(s) can become a Registered User(s) by filling an online registration form on the website & app Or app by giving desired information (Full Name, contact information, etc.).

    Job safety first will establish an account (“Account”) for the user(s) upon registration and assign a user alias (“Email ID”) and password (“Password”) for access to your Account. If you use the Website & app as Registered User, you are responsible for maintaining the confidentiality of your User ID and Password.

    You are responsible for maintaining the confidentiality of your personal and non-personal information and for restricting access to your computer, computer system, and computer network, and you are responsible for all activities that occur under your User ID and Password, email id, and cell number as the case may be.

    If you register on behalf of a business entity, you represent that business entity, and

    • (a) you have the authority to bind the entity to terms and conditions of use and/or this Agreement;
    • (b) the address you use when registering is the principal place of business of such business entity; and
    • (c) all other information submitted to Job safety first during the registration process is true, accurate, current and complete.

    By becoming a Registered User, you consent to the inclusion of your personal and non-personal data in our online database and authorize Job safety first to share such information with other users (s).

    Job safety first may refuse registration and deny the membership and associated User ID and Password to any user for whatever reason. Website & app may suspend or terminate a registered membership at any time without any prior notification in the interest of Job safety first or general interest of its visitors/other members without giving any reason thereof.

    Despite Your organization’s contact number(s) being on the Do Not Call Registry, You consent to be contacted by Job safety first through phone calls, SMS notifications, or any other means of communication, with respect to the services provided by Job safety first.

    You agree, too:
    • Provide true, accurate, current, and complete information about yourself as prompted by the Job safety first’ registration form or provided by You
    • Maintain and promptly update the personal and non-personal Data to keep it true, accurate, current, and complete.

    If you provide any information that is untrue, inaccurate, not current, or incomplete Job safety first has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the User Agreement, Job safety first has the right to indefinitely suspend or terminate or block access of your membership with the Website & app and refuse to provide you with access to the Website & app.

    Use of the www.safetyfirst.co.in

    Please note that in accordance with the Information Technology (Intermediaries guidelines) Rules 2011 in case of non-compliance with the user agreement and privacy policy for access or usage of intermediary computer resource, the Intermediary has the right to immediately terminate the access or usage rights of the users to the computer resource of Intermediary and remove non-compliant information.

    The following requirements apply to your use of the Job safety first Property:
    • you will not use any electronic communication feature of the Job safety first Property for any purpose that is unlawful, tortuous, abusive, intrusive on another’s privacy, harassing, libelous, defamatory, embarrassing, obscene, threatening, or hateful;
    • you will not upload, post, reproduce, or distribute any information, software, or other material protected by copyright or any other intellectual property right (as well as rights of publicity and privacy) without first obtaining the permission of the owner of such rights;
    • you will not collect or store personal data about other users;
    • you will not use the Job safety first Property for any commercial transactions that are unrelated to the purposes for which the Job safety first Property was provided;
    • you will not upload, post, email, or otherwise transmit on interactive features intended for the general public any advertising or promotional materials or any other form of solicitation or unauthorized communication;
    • You will not upload, post, email, or otherwise transmit any material that contains viruses or any other computer code, files, or programs that might interrupt, limit, or interfere with the functionality of any computer software or hardware, or telecommunications equipment.

    You further understand and agree that you have no ownership rights in any account you may have with us or other access to the Job safety first Property or features therein. Job safety first may cancel your account and delete all User Content associated with your account at any time, and without notice, if Job safety first deems that you have violated these Terms, the law, or for any other reason.

    Job safety first assumes no liability for any information removed from our Job safety first Property, and reserves the right to permanently restrict access to the Job safety first Property or a user account.

    By displaying, publishing, or otherwise posting any User Content on or through the Job safety first Property, you hereby grant to Job safety first a limited, nonexclusive, sub-licensable, worldwide, fullypaid, royalty-free license to use, modify, publicly perform, publicly display, reproduce, and distribute such User Content in any and all media now known or hereinafter developed without the requirement to make payment to you or to any third party or the need to seek any third party permission.

    This license includes the right to host, index, cache, distribute, and tag any User Content, as well as the right to sublicense User Content to third parties, including other users, for use on other media or platforms known or hereinafter developed.

    You continue to retain all ownership rights in your User Content, and you continue to have the right to use your User Content in any way you choose, subject to these Terms and the license described herein.

    You further understand and agree that you will not upload any information that:

    1. Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer resource; or contains any Trojan horses, worms, time bombs, or other computer programming routines that may damage, detrimentally interfere with, diminish the value of, surreptitiously intercept or expropriate any system, data or personal information.

    2. Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offense or prevents investigation of any offense or is insulting any other nation.

    Refund & Cancellation Policy

    Job safety first retains the exclusive and sole right as to whether an order may be returned, exchanged, or canceled. Job safety first thus encourages customers to use care when placing an order, as once placed the order cannot be canceled, nor the item returned or exchanged unless Job safety first expressly consents.

    In order to obtain a refund or exchange, prior approval must be given by Job safety first. Please mail us at Info@thesafetyfirst.co.in for the same. Job safety first will consider returns within 5 days of order.

    Due to their product nature, Job safety first cannot accept returns on after use.
